XL Service Body Warranty

In addition to any statutory warranties implied under the laws of the Australia, your XL-Body is protected within Australia by the following warranty hereby given by XL Service Bodies Pty Ltd ('XL') to the purchaser.
XL does not have any liability or responsibility under this warranty where caused by conditions beyond XL’s control including loss, misuse, neglect, accidents, overloading, and Acts of God. The warranty contained herein is for the sole benefit of the Purchaser and is non-transferable to other parties.
XL warrants your XL-Body from any manufacturing defect or faults for12 (twelve) months from installation date or 50,000 (fifty thousand) kilometres, whichever occurs first.
The warranty terms are outlined below.

1. XL’s liability under this warranty is limited, at its discretion only to:
   1. Replacement of the goods or supply of equivalent goods;
   2. Repair of such goods; or cost of replacing the goods or acquiring equivalent goods; or payment of the cost of having the goods repaired.
   3. XL shall not be liable for any labour costs for installation, removal or reinstallation of any defective product to or from the vehicle, or for any rental reimbursement.
   4. The Purchaser shall prepay all freight charges for returning the product to XL, or any other location designated by XL, and for receiving any replacement. 
   5. Any replacement shall be F.O.B. XL’s plant.
2. This warranty does not cover defects or faults caused by:
   1. Damage resulting from fair wear and tear;
   2. Accident, misuse (such as overloading), abuse or neglect;
   3. Failure to undertake regular preventative maintenance according to the recommendations outlined in the vehicle handbook or the maintenance care guide sticker attached to the passenger side front inside panel;
   4. Alterations or modifications to the XL-Body without XL’s’ prior consent;
   5. Door and/or hinge removal; Alterations to the door handle, lock cylinder and associated mechanisms except as required for regular maintenance;
   6. Drilling into the powder coated steel structure;
   7. Any work carried out on the cross-members, mounting brackets or under carriage of the XL-Body;
   8. Any work impacting on the super structure of the XL-Body;
   9. Removal of the XL-Body from the vehicle chassis and/or fitment of the XL Service Body onto another chassis performed by persons not approved or authorized by XL;
   10. Damage caused by carrying corrosive materials;
   11. Accessories or services not furnished by XL, such as optional parts, components, installation, finish painting, lettering, wiring or modifications;
   12. Components, which by their nature may reasonably require periodic replacement due to normal wear, degradation or consumption.
3. XL will only be liable under this warranty for any claim by the purchaser direct, indirect, special or consequential loss or damage in the following circumstances:
4. XL accepts a warranty claim:
   1. The loss or damage alleged arises solely as a result of XL’s' performance or non-performance under the warranty herein;
   2. The loss or damage alleged is limited solely to claims for economic loss;
   3. The loss or damage alleged is supported by documentation acceptable to XL which evidences an economic cost incurred to a third party by XL due to XL’s' performance or non-performance under the warranty herein;
   4. Any liability of XL for any occurred loss or alleged damage to due XL’s performance or non-performance is limited to a maximum of $100.00 per claim.
5. Save for rights under this warranty, XL shall not be liable for, and the purchaser jointly and separately hereby release, discharge and forever hold harmless XL with respect to any and all courses of actions, claims (including, but not limited to claims for legal costs and consequential or economic loss), demands, actions, suits or proceedings of whatsoever nature whether by virtue of the operation of the law of contracts, law of tort, including but not limited to the law of negligence, statute or otherwise and accordingly the purchaser and separately hereby waive any and all rights they may have against XL arising out of the aforesaid.
6. The Parties hereby agree that Clause 5 may be pleaded by XL as a bar to any action commenced or taken at any time by the Purchaser against XL with respect to or in any way connected with an XL Service Body.
7. A warranty will only be considered for acceptance where a written description and photographs of the claim have been presented at the purchaser’s expense directly to XL.  The written description and photographs will be accepted in digital format via email (warranty@designeze.com.au/dev/xl) or print format via mail (XL Service Bodies Pty Ltd, 1219 Boundary Road, Wacol, Qld 4076). Approved warranty claims may be carried out at the Purchasers authorized accident/repair network in accordance or other repairers as directed by XL.
8. This warranty is subject to and conditional upon:
   1.  The XL-Body being properly used and operated at all times in accordance with vehicle manufacturer’s recommendations for correct loading as per the vehicle’s specified GVM and standard, safe loading practices;
   2. The safe, responsible and appropriate operation and driving of the vehicle to which the XL-Body is fitted in accordance with the vehicle owner’s handbook;
   3. All transport expenses if any, relating to the claim being paid by the Purchaser;
   4. All taxes applicable to any claim being paid by the Purchaser;
   5. The cost of all parts and transportation in excess of those which are usual and customary (e.g. express freight) being paid by the Purchaser;
   6.  The Purchaser providing timely notice of any defect or fault covered by this warranty and promptly making the XL-Body available for repair after giving such notice.
9. In addition to any statutory warranties implied under the laws of the Australia, your XL-Body or product is protected within Australia by the following warranty hereby given by XL Service Bodies Pty Ltd (XL).
10. No person is authorized to modify or add to the foregoing Warranty.
